Whether the medical device field can build a special legal system, and how to define the relationship with health and drug-related laws, are all the problems that medical device legal system construction must face. To realize the "up-to-the-center center", we can establish legal-level rules for medical devices, support corresponding management measures, enrich management methods and means, and enhance the effectiveness of medical device management. At the same time, medical device laws and regulations should be integrated with civil law, criminal law and other laws. For example, to clarify the punitive compensation mechanism, improve the civil compensation system for medical devices, in the field of intellectual property rights, focus on medical device products technology complex, patent coverage is difficult to develop the characteristics, improve the medical device field of intellectual property protection rules. In the "capillary" part, the medical device field should focus on regulatory science, formulate and perfect more clear guidance documents, create a multi-sector joint wisdom supervision model, around the medical device listing license holder system, should further refine and improve the management model, clear the holder and production enterprises should bear civil, administrative and criminal legal responsibilities.
